NRI investment taxation

TDS deducted does not always mean tax settled.

For NRIs, the amount withheld, the final tax liability, DTAA relief, return filing and repatriation can be different parts of the same financial story.

Five layers to separate

Do not let one tax deduction hide the complete picture.

01

Residential status

Determine tax residency for the relevant financial year; do not rely only on citizenship or an old status.

02

Income source

Interest, dividends, rent and capital gains can each have different rules and documentation.

03

TDS

Tax may be deducted at source at the applicable rate, but withholding may not equal final liability.

04

DTAA

A tax treaty may provide relief, subject to eligibility, documents and the manner of claiming it.

05

Return & repatriation

Return filing, refund or tax certificate requirements may be separate from remitting money overseas.

Income map

Different income. Different questions.

01

Bank interest

Account type, residential status and statutory conditions matter. Do not assume every Indian bank account receives identical tax treatment.

02

Capital gains

Asset category, purchase and sale date, holding period, transaction route and applicable special provisions can change the calculation.

03

Dividend or distribution

Withholding, return disclosure and treaty eligibility should be reviewed using the relevant statements and tax documents.

04

Property income

Rent, sale proceeds, buyer-side withholding, allowable deductions and remittance documentation can require specialist review.

05

IFSC investments

Tax treatment depends on the investor, product and structure. GIFT City should never be described as universally tax-free.

06

Overseas reporting

The country of residence may require disclosure or taxation even when an investment is held or taxed in India.

A better tax file

Documents that make professional advice more useful.

01

Transaction statements

Capital-gain statements, contract notes, purchase history and corporate-action records.

02

Tax documents

Form 26AS, AIS, TDS certificates and prior-year return or loss information as applicable.

03

Treaty documents

Tax Residency Certificate, Form 10F and supporting declarations where relevant.

04

Banking trail

NRE/NRO account statements, remittance evidence and the proposed destination of funds.

Three common misunderstandings

What sounds simple can become expensive.

01

“TDS has been deducted, so nothing else is required.”
Final liability, return filing, treaty relief or refund entitlement may still need review.

02

“If the money can be repatriated, the tax is complete.”
Banking compliance and tax compliance are connected but not identical.

03

“My NRI status is permanent.”
Residential status can change by financial year and should be reassessed when travel or circumstances change.
